General Conditions

The purpose of these conditions is to regulate the contractual relationship between the accommodation and the user at the time of booking and/or payment of the stay.

The contractual relationship involves the reservation by the accommodation of a stay chosen by the user on a specific date with a check-in and check-out time specified in advance. This contractual relationship will entail the payment of the indicated stay to the accommodation. Such payment may be made in advance from the website or directly at the accommodation. The payment of the amount due may be charged by the accommodation in the event that the user does not show up on the date indicated or cancels outside the period provided for this purpose.

These General Conditions are binding on both parties and form an integral and inseparable part of the contract, all in accordance with the provisions of art. 1,255 of the Civil Code, which reflects the principle of the autonomy of the will and agreements between the contracting parties.

1. Coverage of our services.

HMDD4 operates through the website only in Spanish peninsular territory, in the province of SEVILLE.

The use of this website as well as any reservation made on it is considered to be made in Spain, and therefore subject to Spanish laws and regulations.

2. Booking procedure. – How can I book online?

For you to access the services and rooms offered by HMDD4 and make a reservation you must freely and voluntarily provide personal data that will be required.

It is reported that in accordance with the requirements of art. 27 of Law 34/2002 of Services of the Information Society and Electronic Commerce, the contracting procedure will follow the following steps:


Click on the tab ROOMS where you will be able to consult the characteristics of the rooms and then on the tab “book” where the direct booking option will appear.
Select the desired check-in date and check-out date and then click on the “check availability” option. -You will then be shown the different room options available, what is included in each and their price.

You will then be able to select the room that best suits your needs and click on ADD.
Once you have done this step, on the right side of the page, you will find the summary of your reservation, the total price of the reservation, the percentage of taxes and you will be able to consult the cancellation policy.
Then, you will have to fill in the personal information indicated, the estimated time of arrival if known, complementary services as well as the payment information. These data will only be used to check the validity of the card unless the prepaid mode was chosen when booking the room.
The applicable prices will be those published on the website, and automatically applied by the contracting process in the last phase of the same. In any case this will always be previously communicated to the users.

For any information about the reservation, the user can contact customer service through the email or telephone indicated above. HMDD4  reserves the right to modify its prices at any time. It will be billed at the price in effect at the time of booking and payment, except for obvious typographical errors.

3. Information about the rooms.

The descriptions of the rooms offered on the portal are made based on the catalog of images available by the accommodation.

The photographs, graphic or iconographic representations and videos, as well as trade names, trademarks or distinctive signs of any kind contained in the website are intended to provide the most information, however, the user must take into account that they are for guidance purposes and, therefore, lack exhaustive character.

It is necessary to warn the user that in some cases the images offered with the description may not match exactly, in these cases will always prevail the description made in the booking form. These cases, will be exceptional since the intention of HMDD4  is to always offer a faithful image of the offered product.

Likewise, in order to guarantee more complete information, we will also indicate the existence of available rooms for the dates previously indicated. In the event that there is any error and the selected room is not available after any payment has been made, HMDD4  will inform the user of the total cancellation or, where appropriate, partial cancellation of the reservation and the refund of the price if applicable. In any case, provided that the error was not due to lack of availability for those dates, you will be offered the possibility of keeping your reservation in rooms of equal or superior performance without charging a different price. However, if the dates selected by the client coincide with those of high season, the price could be altered.

4. Price information.

The price of each room will be the one stipulated at all times on our website, except in case of manifest error. Although we try to ensure that all prices listed on the site are correct, errors may occur. If we discover an error in the price of any of the services you have ordered, we will inform you as soon as possible and give you the option of reconfirming your booking at the correct price or cancelling it.


Prices may vary at any time, without such modification affecting reservations already made. They are considered high season:

  • From early/mid-March to mid/late June.
  • From mid-September to mid-November

The rest of the year will be considered low season, except for holidays such as Christmas, Epiphany, Easter and April Fair or other similar ones, in which price increases may be observed according to demand and which will be considered high season.

The prices indicated for each service will be expressed in Euro currency (€). Unless otherwise stated, the prices shown on our website include legally applicable taxes (Spanish VAT).

5. Management fees.

The reservation through our website is made and managed directly with us and we do not charge any management fee which can be applied in case of opting for intermediaries.

6. Offer and acceptance.

The contracting procedure and the pre-contractual information is in Spanish and this language will be the one used to carry out the contracting. In the event that it can be carried out in another language, this will be indicated before initiating the contracting procedure.

7. Information on means of payment.

The payment of the price through the web can be made if the chosen method is pre-payment. Otherwise, you must pay the amount of the price at the moment of your arrival during the Check In at the accommodation. You can only be charged in advance when you cancel outside the period indicated in the cancellation policy section or when you have not shown up at the accommodation on the date of the reservation without prior notification in due time and form. You will receive a confirmation email with a summary of your reservation.


HMDD4 declares to have limited access to bank details or store sensitive data relating to the means of payment used by the User, except those strictly necessary for the management of the payment. Only the corresponding financial institution processing the payment has access to these data for the management of payments and collections. Once the purchase process is completed, an electronic document is generated in which the contract is formalized and that the user can print.

HMDD4 reserves the right to cancel reservations in the cases and according to the terms and conditions indicated in the “Cancellations” section of these Terms of Use and Contracting.

What payment method can I use to pay online?

The payment of the products offered by the entity can be made by means of:

  1. Credit or debit card. (No increase on the final price).
    If your payment method is by credit card, by clicking on “Buy and proceed to payment” you are confirming that the credit card is yours. If you receive a notification that your card has been declined and you have verified that the card has not expired and that the information number associated with your card does not contain any errors, you should contact your bank first to find out the reason for the declined or unauthorized payment.
  2. If you choose PayPal as your payment method, once the reservation has been made, you are not allowed to make any changes, taking into account the provisions of the cancellation section of this document.
  3. Payments at reception by credit card or cash. This means of payment is considered as cash payment and by Law 7/2012, of October 29, amending the tax and budgetary regulations and adaptation of financial regulations for the intensification of actions in the prevention and fight against fraud. In this case, the limitation of cash payments of €2,500 to the same customer in the period of one year is established.


If the method chosen by the customer is cash payment at the hotel reception, at the time of check-in at the hotel must show or leave the credit card number verifying that it is the same with which the reservation was made. This credit card number will also be kept in case there is an overcharge.


Once the reservation is made, we will send to the user’s email, within twenty-four hours (24 hours) an email acknowledging receipt and confirmation of the reservation made.

Is it safe to enter my credit card information on the web?

As you can see in our security policy, our payment is secure using the means indicated. We have an SSL certificate that allows us to protect the banking information transferred in the process using encryption methods. The confidential data of the payment by credit or debit card are transmitted directly and securely to the financial institution.

When making the payment through the secure payment gateway, the system will automatically verify that the credit card is enabled for Secure e-Commerce. It will then connect to the issuing bank, which will request authentication and authorization of the transaction.

My card has been declined, what can I do?

If you receive a notification that your card has been declined, you should first contact your bank to find out why. However, this can happen for a number of reasons:

  1. The most common reasons why a payment is rejected are related to payment security policies. When making the payment through the secure payment gateway, the system will automatically verify that the card is activated for Secure Electronic Commerce. It will then connect to the issuing financial institution, which will ask the buyer to authorize the transaction by means of a personal authentication code. The transaction will only take place if the credit card issuing bank confirms the authentication code and the card will then be charged. Otherwise, the transaction will be declined.
  2. The card may be expired. Check that your card does not exceed the expiration date.
  3. Credit limits or funds withholding: The card’s limit for purchases may have been reached.
  4. Incorrectly entered data. Check that you have filled in all the required fields with the correct information.

In any case, your bank is the only one that can provide you with the exact reason why a payment has been rejected.


My card has been used fraudulently, what should I do?

You must notify HMDD4 through the email or telephone number indicated at the beginning of this document, of any undue or fraudulent charge on the card used for purchases on the web, in the shortest possible time, in order that HMDD4 can take the steps it deems appropriate.

8. Invoice information.

You will be able to request your invoice at the same time of the payment of your stay in the accommodation. In case of payment via web, this is issued in electronic format and you can request it on paper when you go to the hotel.


The invoice will be issued in the name of the natural or legal person placing the order, so the User must ensure that the correct and complete data of the purchaser is entered. Subsequent changes will not be possible.


HMDD4 warns that, to preserve the confidentiality of the data, only duplicate invoices will be issued to the contract holder. Duplicates will not be issued to third parties.

9. Rooms

Our rooms are as follows:


  • Standard
  • Superior
  • Deluxe

We inform you that our hotel does not allow the accommodation of children under 18 years old, nor pets are allowed. The maximum number of people allowed in each room is 2.

10. Check In and Check Out

You can check in online or in person. Reception hours are from 08:00 to 20:00h. If your arrival is between 20:00 and 00:00, a late check-in supplement of 20€ will be charged, to be paid in cash at the reception desk upon arrival. After 00:00, check-ins are subject to confirmation by the establishment. If we have not received a response by 7:00 p.m. on the day of your arrival time, your reservation may be cancelled.


The usual check-in time is estimated at 14:00h, ensuring the proper cleaning of the room. However, if the room is ready before that time, the new guest may have it at his disposal from 12:00h, coinciding with the Check Out of the previous customer.


After 20:00h we can be reached at (+34) 623 030 396. After this time, keep the entrance door of the establishment closed. Respect the rest of the other guests from 23:00 to 09:00h, avoiding slamming doors and televisions, music and loud voices.


In addition, a damage deposit of 85 € will be charged for non-compliance with regulations (such as making noise, or bringing more people in the room than allowed, inviting people outside the establishment to the pool or gym or smoking inside the room. In the event that the client smokes inside the room, apart from the 85 €, an amount of 200 € will be charged for cleaning the room to recondition it to a smoke-free space.


The check out will be at 12.00 PM. the day of completion of your reservation. If your departure is before 8.00 AM, upon arrival you will be told where to leave the keys. In case of late check out, available only until 1.30 PM, you must request it at reception and pay a supplement of 15€ (always subject to availability at the time). Any departure after the indicated time must be paid as an extra night.


The reservation will have a minimum term of one night and a maximum of 30 nights. Any variation and/or extension must be previously communicated to the hotel and will be subject to availability.


11. Services included and additional services

Services included:

  • Seasonal swimming pool open to the public from May to September and has a maximum capacity of 4 people. Opening hours are from 11:00 to 22:00h. You can request your towels at the reception desk.
  • Gym from 09:00 to 22:00h.
  • Reception and permanent and continuous attention to the client in a space destined to the effect, (NOT 24 HOURS RECEPTION).
  • Daily cleaning of the room, unless otherwise indicated by the client.
  • Periodic change of bed and bath linen, every 3 days towels and every 4 days sheets. Other services available to the client: laundry, luggage storage, etc. You can ask for more information at the e-mail address above or on our web site.
  • Safe at the reception.

Additional services for a fee


  • Classes with personal trainer (subject to availability and 48h prior reservation).
  • Transfers from/to accommodation (35 € from the airport to the accommodation and 30 € from the accommodation to the airport). Must be booked in advance.
  • Transfers from Seville-Santa Justa train station to the hotel (at a cost of 25 €, prior reservation by the client).
  • Food and catering services (breakfast available from October 2021 at a cost of 8€).
  • Experiences.


12. Cancellations.

The cancellation policies applied by HMDD4 are the following:.


  • Flexible 7 days, if you cancel outside the 7 days prior to arrival no charge will be made. Within 7 days prior to arrival, the first night will be charged.
  • Flexible 2 days, if cancelled less than 2 days prior to arrival, no fee will be charged. Within 2 days prior to arrival, 100% of the stay will be charged.
  • Non-refundable, you can cancel free of charge within 24 hours after booking. After that, if you cancel, 100% of the stay will be charged.

To cancel your reservation you can do it from the confirmation email that you will have in your email or by sending an email to the email indicated above with the details of your reservation. If you have made your reservation through a channel other than the HMDD4  website, you must cancel your reservation through that channel.

We may decide to cancel your reservation in the following cases:


  1. When we are unable to obtain authorization of your payment;
  2. When your credit card is not valid
  3. When the room shown on the Platform contains a manifest error, such as the price not being correct or incorrectly shown or described;
  4. When we are unable to process the order for technical reasons;
  5. Where we know or reasonably suspect that the order has been placed with the aid or intervention of any software, robot, crawler, spider or any other automated device or procedure.


13. Warranties and Information.

All warranties recognized to you as a consumer under applicable law shall apply.

You will have the possibility to rate and comment on our services; to avoid offensive, violent, illegal, spam, etc. comments, these will be subject to our validation. You will be solely responsible for the comments you leave on our website, not being responsible in any case HMDD4 of them, nor having any obligation to publish them.


14. Liability and disclaimer of liability.

Our conditions of purchase do not exclude or limit our liability for:


  1. Death or personal injury caused by our negligence,
  2. Fraudulent misrepresentation,
  3. Any other liability which cannot be limited or excluded by applicable law.

Without limiting the foregoing, we shall not be liable for:


  1. Economic loss (including loss of income, data, profits, contracts, business or anticipated savings) or loss of goodwill or reputation or loss of special or consequential loss or damage suffered or incurred by you arising out of or in connection with these Conditions.
  2. The loss of or damage to any personal property suffered as a result of its failure to be properly deposited in the safe available at the front desk of the establishment.
  3. Accidents occurring as a result of the uncivic behavior of customers.
  4. Consequences derived from non-compliance with the rules of coexistence of the establishment.

In all these cases, the contract may be broken and the stay may be terminated de facto if the establishment deems it convenient.

5. Cases of force majeure which shall include any act, event, default, omission or accident beyond our reasonable control and shall include in particular (without limitation) the following events:

  • Strikes, lockouts or other industrial action.
  • Civil commotion, riot, invasion, terrorist attack or terrorist threat, war (whether declared or not) or threat or preparation for war.
  • Fire, explosion, storm, flood, flood, earthquake, subsidence, epidemic or any other natural disaster.
  • Impossibility to use trains, ships, airplanes, motor transport or other means of transportation, public or private.
  • Impossibility of using public or private telecommunications systems.
  • Acts, decrees, legislation, regulations or restrictions of other governments.


During the aforementioned events, the obligations acquired in this contract shall be understood to be suspended as long as the cause that originated it persists.


The provisions of this paragraph do not affect your legal rights as a consumer, nor your right to withdraw from the contract.

15. Dispute Resolution.

Applicable legislation and jurisdiction.

The relationship between HMDD4  and the Consumer and User shall be governed by Spanish law. In accordance with the provisions of Article 90.2 of the TRLGDCU, all disputes and claims arising from this legal notice shall be resolved by the Courts and Tribunals of the consumer’s domicile.

Extrajudicial resolution of conflicts.

In accordance with the provisions of Article 14.1 of Regulation 524/2013 of the European Parliament and of the Council of 21 May 2013 on the resolution of online consumer disputes, the consumer and user is informed that in case of conflict may resort to the extrajudicial resolution of disputes online

Complaint forms.

In case you want to file a complaint, we inform you that we have complaint forms at your disposal that you can request at the email address indicated above or in the same establishment. You can do it through this same channel or in person at the reception.


16. Minors.

HMDD4 directs its services to users over 18 years old. Minors under this age are NOT authorized to use our services and should not, therefore, send us their personal data. We inform that, if such a circumstance occurs HMDD4  is not responsible for the possible consequences that may arise from the breach of the notice in this clause is established.

17. Intellectual Property Claims.

HMDD4 respects the intellectual property of others. If you consider that your intellectual property rights may have been infringed, please notify us of this incident to email: HMDD4


18. Security Policy.

HMDD4 has contracted for its website an SSL certificate.


An SSL certificate protects all personal and confidential information that can be handled on a website, regardless of the information that is being transmitted, such as from any of the contact forms on the website to the server, or data entered for the subscription of newsletters or access to protected areas, etc..


The website address will appear in green, activating the “https” protocol that allows secure connections from a web server to the user’s browser.


19. Sweepstakes on Social Networks.

In the event that we conduct sweepstakes on Social Networks such as Facebook or Instagram, you should know that these platforms do not sponsor or associate in any way with the organizer of the same.

The participant exonerates Facebook / Instagram from any type of responsibility caused by the non-compliance with the legal Bases of the sweepstakes.
